1) <br /> <br />A. Definitions <br /> <br />For the purposes of these Conditions of Approval the following definitions shall apply: <br /> <br />a) City: Unless otherwise specified, "City" shall mean City of Pleasanton. <br /> <br />b) <br /> <br />Condition(s): "Condition" or "Condition of Approval" shall mean a condition of <br />these Conditions of Approval for the Bemal Property PUD Development Plan. <br /> <br />c) <br /> <br />Conditional Use: "Conditional Use" shall mean a conditional use as defined in <br />the City of Pleasanton Municipal Code. <br /> <br />d) <br /> <br />Developer: Unless otherwise specified, when used in a generic sense the term <br />"developer" shall mean the person or entity directly responsible for development <br />of an individual Parcel, Development Parcel, structure, or combination thereof, <br />including off-site improvement obligations as may be indicated by the context of <br />the individual Condition. This may be the Property Owner, the Parcel Developer, <br />both, or another individual or entity. <br /> <br />e) <br /> <br />Development Agreement: The "Development Agreement" shall mean the <br />agreement entered into between the City of Pleasanton and GHC Bernal Investors, <br />LLC pursuant to California Government Code §§ 65864 et sea. <br /> <br />f) <br /> <br />Development Parcel, Parcel: Unless otherwise specified, a "Development Parcel" <br />or "Parcel" is one of the Parcels created by filing of a final subdivision map <br />(hereinaRer Final Map) based on the Bemal Property PUD Development Plan. <br />Parcel numbers (e.g., Parcel 1) refer to Parcel numbers as shown on Figure 3-2, <br />Phase I Parcel Plan of the Bernal Property Specific Plan. <br /> <br />g) <br /> <br />Development Standards and Guidelines: The "Bemal Property PUD <br />Development Standards and Guidelines" shall refer to those development <br />standards and design guidelines incorporated into this PUD by reference as <br />adopted by the City Council on ,1998 and any modifications thereto. <br /> <br />h) <br /> <br />Final Environmental Impact Report, Final EIR, FEIR: The "Final Environmental <br />Impact Report," "Final EIR," or "FEIR" shall mean the Final Environmental <br />Impact Report certified by the City of Pleasanton for the Project, dated <br />March 1999. <br /> <br />i) <br /> <br />Improvement Agreement: "Improvement Agreement" shall mean the agreement <br />for implementation of public improvement(s) identified in the Improvement Plan <br />as set forth in the Subdivision Map Act, California Government Code §§ 66410 et <br />seq. Depending upon the timeframe for implementation of certain public <br />improvements, as provided within these Conditions, certain public improvements <br />may not be necessitated within the timeframes provided under the Subdivision <br />Map Act, and "Deferred Improvement Agreements" may be necessitated. <br /> <br />Conditions of Approval Page 1 of 44 August 9, 2000 <br /> <br /> <br />
