CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-084 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION OF THE CITY OF PLEASANTON <br />AUTHORIZING THE ISSUANCE, SALE AND DELIVERY OF <br />CITY OF PLEASANTON VARIABLE RATE <br />MULTI-FAMILY HOUSING REVENUE BONDS (BERNAL <br />APARTMENTS PROJECT) 2001 SERIES A AND CITY OF <br />PLEASANTON TAXABLE SUBORDINATE MULTI-FAMILY <br />HOUSING REVENUE BONDS (BERNAL APARTMENTS <br />PROJECT) 2001 SERIES A-TS, AUTHORIZING THE <br />EXECUTION AND DELIVERY OF A TRUST INDENTURE, <br />AN INDENTURE OF TRUST, A FINANCING AGREEMENT, <br />A LOAN AGREEMENT, A REGULATORY AGREEMENT, <br />AN OFFICIAL STATEMENT, A BOND PURCHASE <br />AGREEMENT, AND ASSIGNMENT AND INTERCREDITOR <br />AGREEMENT, AND AUTHORIZING THE EXECUTION OF <br />AND DELIVERY OF AND APPROVING OTHER RELATED <br />DOCUMENTS AND APPROVING OTHER RELATED <br />ACTIONS IN CONNECTION THEREWITH <br /> <br />Chapter 7 of Part 5 of Division 31 of the Health and Safety Code of the State of <br />California, (the "Act"), authorizes cities and counties to incur indebtedness for the <br />purpose of financing the acquisition, construction rehabilitation and development <br />of multi-family rental housing facilities to be occupied in part by persons of low <br />and very low income; and <br /> <br />the City Council (the "City Council") of the City of Pleasanton (the "City") hereby <br />finds and declares that it is necessary, essential and a public purpose for the City to <br />engage in a program (the "Program") of financing the acquisition, construction and <br />development of multi-family rental housing facilities, and has determined to <br />borrow money for such purpose by the issuance of revenue bonds as authorized by <br />the Act; and <br /> <br />the City Council hereby finds and declares that this resolution is being adopted <br />pursuant to the powers granted by the Act; and <br /> <br /> <br />
