alteration agreements prior to any grading or fill activities on areas determined to be <br />within the jurisdiction of the US Army I~orl)S t)f Engineers or the California <br />Del~llnen~ offish and Game. The Property Owner shall obtain! ally necessary 1603 <br />Stre~mbed Alteration Agreements from the California Department ofFish and Game <br />prio¢ to approval of grading permits for any grading activities. If the regulatory <br />age~lci~ concur with the conclusions of the biological resources analysis that the <br />fing~r tributary area does not meet the definition of a wetland and/or it does not <br />constitute a significant habitat area then no further mitigation will be required. If it is <br />det~'nlined the habitat is significant, a Streambed Alteration Agreement will provide <br />mitigation to reduce the adverse impact to a less than significant level. <br /> b. Measure O2c was selected because: retaining the city creek channel in the <br /> conlex~ of adjacent land uses would effectively eliminate its habitat value; it is not a <br /> wetland; and conformity with permit requirements, including possible replacement <br /> habitat in a better site environmentally, is a superior choice. <br /> c. Alternative C of the Greenbriar Project would eliminate residential <br /> development in the East Parcel and eliminate impacts to creeks and channels in that <br /> area. Alternative B provides that the residential units in the East Parcel will be <br /> reduced in number to provide greater setbacks from the creeks and channels. <br /> d. The G-reenbriar Project Phase I impacts fewer acres of the project site than <br /> the Cooperative Plan or the Preferred Plan. Many areas with creeks and channels are <br /> undisturbed by Phase I, as these areas are located within the currently unplanned future <br /> public spaces, development of which will be subject to further environmental review. <br /> 3. [~L_Q~. Potential adverse effects on wetlands as a result of future development. <br /> <br />Mi' tion Me ures: <br />Measure O4a. Prior to the approval ora final grading, plan, verify and delineate the <br />loc~tions of wetlands on the site. <br />M~asure O4b. If wetlands that would be adversely affected by the project are <br />delineated on the site as a result of Measure O4a, require the preparation ora <br />mitigation plan, including an avoidance alternative, that will meet federal and state <br />requirements prior to the approval of a final grading plan. <br />F~d~: Changes or alterations have been required in, or incorporated into, the <br />Project which avoid or substantially lessen the significant environmental effect <br />identified in the Final EIR to a less than significant level. <br /> Facts in Sunt~ort of Finding: The imlyaet will be avoided or reduced based on the <br /> following: <br /> <br />45 <br /> <br /> <br />
