PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-2000-13 RESOLUTION DENYING CASE PAP-02, THEREBY UPHOLDING THE ZONING ADMINISTRATOR'S DETERMINATION OF THE ALLOWABLE LOCATION FOR SOLID FENCING ADJACENT TO THE NORTHERN SIDE LOT LINE OF THE PROPERTY LOCATED AT 6213 DETJEN COURT the Zoning Administrator determined that the solid fence installed in the northern side yard of the property located at 6213 Detjen Court extended approximately 19 feet beyond the graded building pad and does not comply with the subdivision's fencing regulations; and WHEREAS, the property owner filed an appeal of the Zoning Administrator's determination; and WHEREAS, zoning for the property is PUD-LDR/OS (Planned Unit Development - Low Density Residential/Open Space) District; and at its duly noticed public hearing of February 9, 2000 the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, actions of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); therefore, no environmental document was prepared for this proposal; and the Planning Commission determined that the last 19 feet of solid fencing adjacent to the northern side lot line of the property located at 6213 Detjen Court must be removed, and, if fencing is desired, replaced with open view fencing installed in conformance with the fencing guidelines stated in the "Fire Protection & Landscape Guidelines for the Preserve." NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Denies Case PAP-02, thereby upholding the Zoning Administrator's determination of the allowable location for solid fencing adjacent to the northern side lot line of the property located at 6213 Detjen Court.
