PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2000-35 <br /> <br />RESOLUTION DENYING CASE PAP-08, THEREBY UPHOLDING THE <br />ZONING ADMINISTRATOR'S APPROVAL OF CASE PADR-28/PV-3 (THE <br />APPLICATION OF MIKE AND JANE CAREY) <br /> <br />the Zoning Administrator approved the application of Mike and Jane <br />Carey for a variance and administrative design review for a 22-foot high, <br />598-square-foot detached garage with an approximately 368-square-foot <br />second floor located at 383 Division Street; and <br /> <br />within the time specified by the City of Pleasanton Municipal Code, a <br />neighbor filed an appeal of the Zoning Administrator's action with the <br />Planning Department; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) Zoning <br /> District; and <br /> <br />at its duly noticed public hearing of June 28, 2000 the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />actions of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); therefore, no <br />environmental document was prepared for this proposal; and <br /> <br />the Planning Commission determined that the variance would allow the <br />applicant to obtain a better design than would be achieved if the applicant <br />was required to comply with the detached accessory structure height limit. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies Case PAP-08, thereby upholding the Zoning Administrator's <br />approval of Case PADR-28/PV-03, the application of Mike and Jane <br />Carey for a variance and administrative design review for a 22-foot high, <br />598-square-foot detached garage with an approximately 368-square-foot <br />second floor located at 383 Division S~xeet. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br /> <br /> <br />
