The proposed location of the conditional use and the conditions <br /> under which it would be operated or maintained will not be <br /> detrimental to the public health, safety, or welfare, or materially <br /> injurious to the properties or improvements in the vicinity. <br /> <br />As conditioned, the operation of the birthing center will not negatively <br />alter the mixed use character of the downtown area, but rather, it would <br />enhance the diversity of land uses in this district. In addition, the birthing <br />center will not interfere with surrounding uses' ability to operate. The <br />proposed use will have adequate off-street parking and on-street parking <br />along Railroad Avenue to meet the anticipated demand for parking <br />generated by the center's operation. The birthing center would not subject <br />surrounding uses to heavy track traffic, hazardous conditions, or other <br />objectionable influences. As conditioned, the proposed use will be <br />compatible with adjacent uses. <br /> <br />The proposed conditional use will comply with each of the <br />applicable provisions of the zoning ordinance. <br /> <br />If the accompanying code amendment is approved, birthing centers would <br />be a conditionally permitted use in the Central Commercial (C-C) District. <br />In addition, the proposed use complies with all relevant sections of the <br />zoning ordiuanee, as conditioned. Granting a conditional use permit to the <br />applicant would be consistent with the City's ability to regulate zoning as <br />listed in the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, the Planning Commission determined that the proposed birthing center <br /> would operate in a manner compatible with the surrounding neighborhood. <br /> <br />NOW, THEREFORE, THE PLANNING COMlVllSSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Soot. ion 1. <br /> <br />Approves Case PCUP-14, the application of Tri-Valley Ob/CJynfDr. <br />Michael Bleecker, M.D. and Beah Haber, CNM for a conditional use <br />permit to operate a birthing center at 4441 Railroad Avenue, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this <br />case by reference. <br /> <br />Se~ion 2. This resolution shall become effective 15 days after its passage and <br /> adoption unless appealed prior to that time. <br /> <br /> <br />
