Resolution No. PC-2000-34

2. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or materially
injurious to the properties or improvements in the vicinity.

As conditioned, the operation of the birthing center will not negatively
alter the mixed use character of the downtown area, but rather, it would
enhance the diversity of land uses in this district. In addition, the birthing
center will not interfere with surrounding uses' ability to operate. The
proposed use will have adequate off-street parking and on-street parking
along Railroad Avenue to meet the anticipated demand for parking
generated by the center's operation. The birthing center would not subject
surrounding uses to heavy track traffic, hazardous conditions, or other
objectionable influences. As conditioned, the proposed use will be
compatible with adjacent uses.

The proposed conditional use will comply with each of the
applicable provisions of the zoning ordinance.

If the accompanying code amendment is approved, birthing centers would
be a conditionally permitted use in the Central Commercial (C-C) District.
In addition, the proposed use complies with all relevant sections of the
zoning ordiuanee, as conditioned. Granting a conditional use permit to the
applicant would be consistent with the City's ability to regulate zoning as
listed in the Municipal Code Chapter 18.124.

WHEREAS, the Planning Commission determined that the proposed birthing center
would operate in a manner compatible with the surrounding neighborhood.

NOW, THEREFORE, THE PLANNING COMlVllSSION OF THE CITY OF
PLEASANTON RESOLVES THE FOLLOWING:

Soot. ion 1.

Approves Case PCUP-14, the application of Tri-Valley Ob/CJynfDr.
Michael Bleecker, M.D. and Beah Haber, CNM for a conditional use
permit to operate a birthing center at 4441 Railroad Avenue, subject to the
conditions shown in Exhibit "B," attached hereto and made part of this
case by reference.

Se~ion 2. This resolution shall become effective 15 days after its passage and
adoption unless appealed prior to that time.
