Resolution No. PC-2000-25 <br />Page 4 <br /> <br /> EXHIBIT B <br />Conditions of Approval <br />164 Ray Street, Suite D <br />Case PCUP-4 <br /> <br />The operation of the proposed personal fitness training with massage services use <br />shall substantially conform to the floor plan, site plan, and written narrative, Exhibit <br />A, dated "Received February 17, 2000," on file with the Planning Department, except <br />as modified by the following conditions. Minor changes to the plans may be allowed <br />subject to the approval of the Zoning Administrator if found to be in substantial <br />conformance with the approved exhibits. <br /> <br />The personal fitness training and massage services shall be provided on a one-on-one <br />basis only. No group sessions shall be provided. <br /> <br />On days in which the massage technician and the personal fitness trainer will be at <br />164 Ray Street at the same time, the massage technician and the personal fitness <br />trainer are encouraged to either walk, bicycle, take public transit, or carpool to the <br />site. If the massage technician and the personal fitness trainer carpool, they shall park <br />on Ray Street as close to the Adobe Plaza shopping center as possible. <br /> <br />There shall be a 15-minute break between all massage sessions and a 15-minute break <br />between all personal fitness training sessions. During the 15-minute break, no <br />sessions shall be held. <br /> <br />The front door of 164 Ray Street suite D shall be closed at all times except for <br />ingress/egress or emergency purposes. <br /> <br />The manager of the business at 164 Ray Street suite D shall inform all clients not to <br />loiter or make loud noises outside the building before or after personal fitness training <br />and massage sessions. The inability of the manager to prevent such nuisances shall <br />be cause for further review and possible revocation of this use permit by the Planning <br />Commission. <br /> <br />If operation of this use results in conflicts pertaining to noise, parking, traffic, or any <br />other impacts, at the discretion of the Planning Director, this conditional use permit <br />may be referred to the Planning Commission for subsequent review at a public <br />hearing. If necessary, the Planning Commission may modify or add conditions of <br />approval to mitigate such impacts, or may revoke said use permit. <br /> <br />If the applicant wishes to relocate the personal fitness traluing with massage services <br />use, the applicant shall secure a new conditional use permit to relocate into the tenant <br />space or building prior to occupying the tenant space or building. <br /> <br />{end} <br /> <br /> <br />
