PLANNING COIVIIVIISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. PC-2000-19 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF YVONNE MC ARDLE FOR A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE PCUP-03 <br /> <br />WHEREAS, Yvonne McArdle has applied for a conditional use permit to operate a tutoring <br /> center in an existing office building located at 4125 Mohr Avenue, Suite K; and <br /> <br />WHEREAS, zoning for the property is O (Office) District; and <br /> <br />at its duly noticed public hearing of March 8, 2000, the Planning Commission <br />considered ail public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, a modification such as that proposed is categoricaily exempt fxom the <br /> requirements of the California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The proposed use requires relatively simple physicai facilities in which to operate. <br />The office building can provide an appropriate environment in which such an <br />inslmction-odented use would be compatible with adjacent office uses and <br />consistent with the objectives of the office zoning district in which it is located. <br /> <br />The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heaith, safety, or welfare, or matedaily injurious to the properties or <br />improvements in the vicinity. <br /> <br />As proposed, this use should not generate any unusual demands on existing <br />parking for the office complex. The proposed use is to be operated entirely <br />indoors and activities should not interfere with adjacent uses. As conditioned, the <br />proposed learning center would meet the occupancy and other requirements of the <br />Pleasanton Municipal Code, Fire Code, and Uniform Building Code. A condition <br />has been included that would require the applicant to mitigate any future nuisances <br />that may arise from the proposed use. <br /> <br /> <br />
