19 <br />City, evidencing the same debt as the Bonds surrendered, and shall be entitled to all <br />the benefits and protection of this Resolution to the same extent as the Bonds ih <br />exchange for which they were executed and delivered. <br /> SECTION 2.09. Bonds Mutilated, Lost or Destroyed. In case any Bond <br />shall become mutilated in respect of the body of such Bond or the coupons, if <br />any, appertaining thereto, or shall be believed by the City to have been destroyed, <br />stolen or lost, upon proof of ownership satisfactory to the City and upon the sur- <br />render of such mutilated Bond with its coupons, if any, at the office of the Fiscal <br />Agent or at any other office or agency of the City maintained for such purpose, <br />or upon the receipt of evidence satisfactory to the City of such destruction, theft or <br />loss, and upon receipt also of indemnity satisfactory to the City, and upon payment <br />of all expenses incurred by the City for any investigation relating thereto, and for <br />each new Bond issued under this Section, the City shall execute and deliver at <br />the office of the Fiscal Agent a new Bond or Bonds of the same maturity and <br />for the same aggregate principal amount, with the coupons, if any, appertaining <br />thereto, of like tenor and date, bearing the same issue number or numbers, with <br />such notations as the City shall determine, in exchange and substitution for and <br />upon cancellation of the mutilated Bond and its coupons, if any, or in lieu of and <br />in substitution for the Bond and its coupons, if any, so destroyed, stolen or lost. <br /> If any such destroyed, stolen or lost Bond shall have matured, payment of the <br /> amount due thereon may be made by the City, upon receipt of like proof, indem- <br /> nity and payment of expenses. <br /> Any duplicate Bonds or coupons issued pursuant to this Section 2;0~ shall <br /> be entitled to equal and proportionate benefits with all other Bonds issued here- <br /> under. Neither the City, the Fiscal Agent nor any Paying Agent shall be required <br /> to treat both the original Bond and any duplicate Bond as being outstanding for <br /> the purpose of determining the principal amount o£ Bonds whichlmay be issued <br /> hereunder or for the purpose of determining any percentage of Bbnds outstanding <br /> hereunder, but both the original and duplicate Bond shall be treated as one and <br /> the same. <br /> SECTIO~ 2.10. Temporary Bonds. Until definitive Bonds of any series shall <br /> be prepared, the City may cause to be executed and delivered .in l~_ieu of such <br /> definitive Bonds and subject to the same provisions, limitations and conditions <br /> as are applicable in the case of definitive Bonds, except that they may be in any <br /> denominations authorized by the City and shall be registrable as to both principal <br /> and interest and may be discharged from registration in the same manner and <br /> subject to the same provisions herein contained applicable to definitive Bonds, <br /> one or more temporary, printed, lithographed, typed or engraved Bonds in bearer <br /> form without coupons, or with one or more coupons, as may be authorized by <br /> the City, substantially of the same tenor and, until exchanged for definitive Bonds, <br /> entitled and subject to the same benefits and provisions of this Resolution as defini- <br /> tive Bonds of the same series and maturity.
