Section 27. Separability of Provisions <br /> In the event that any provision of this Memorandum of Understanding is declared by a court of <br /> competent jurisdiction to be illegal or unenforceable, that provision of the Memorandum of <br /> Understanding shall be null and void, but such nullification shall not affect any other provisions of <br /> this Memorandum of Understanding, all of which other provisions shall remain in full force and <br /> effect. <br /> Section 28. Printing of Memorandum of Understanding <br /> The City shall print one hundred fifty (150) copies of this Memorandum of Understanding in <br /> booklet form including a table of contents. The City and the Association shall share the cost of the <br /> printing. The Association shall assume responsibility of distributing copies to represented <br /> employees. <br /> Section 29. Miscellaneous <br /> 29.1 Americans with Disabilities Act <br /> The City and the Association recognize that the City has an obligation under law to meet with <br /> individual employees who allege a need for reasonable accommodation in the workplace because <br /> of a disability. If by reason of the aforesaid requirement the City contemplates action to provide <br /> reasonable accommodation to an individual employee in compliance with the ADA which are in <br /> potential conflict with any provisions of this Memorandum of Understanding, the Association will <br /> be advised of any such proposed accommodation and be afforded an opportunity to discuss same <br /> prior to implementation by the City. <br /> 29.2 Seniority Shift Sign tip <br /> Effective the first pay period after January 1, 1999, the Seniority Sign Up Program attached as <br /> Exhibit C shall be implemented in the Operations Division. <br /> 29.3 Hours of Work <br /> Schedule <br /> The four -10 work schedule will apply to officers and sergeants assigned to work in the Operations <br /> Division's Patrol and Traffic Bureaus. This work schedule will commence the first pay period <br /> following January 1, 2001. Officers and sergeants will work four 10 hour shifts each week, then <br /> take three consecutive days off. <br /> All other officers and sergeants will continue to work the five -9 work schedule as originally <br /> agreed upon and outlined in the Memorandum of Understanding dated April 1, 1995, through <br /> March 31, 1998. <br /> Conditions <br /> 1. An employee's schedule may be suspended and replaced by a "Five -8" work schedule in <br /> case of formalized raining courses, military leave, and limited duty occurring in any <br /> portion of one or more pay periods. <br /> 2. The starting and ending time of work shifts will remain a management prerogative. Once <br /> established, they may be changed over the long term. <br /> - 21 - <br />
