CITY OF PLEAS&NTO~ <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 69-~? <br /> <br /> AUTHORIZING CITY OFFICERS TO E~ECUTE AGREEMENT BETWEEN THE <br /> ROMAN CATHOLIC BISHOP AND CITY OF PLEASANTON, AND AUTHOR- <br /> IZING CITY ATTORNEY TO DISMISS~SUIT <br /> <br />WHEREAS: The City Council did consider at executive session on <br /> <br /> April 7, 1969, a proposed agreement between the Roman <br /> Catholic Bishop of Oakland and the City of Pleasanton <br /> by way of settlement of a previously filed condemnation <br /> suit; and <br /> <br />WHEREAS: The City Council did carefully consider the terms of <br /> the proposed agreement, and the dates upon which the <br /> street improvement obligation assumed by the City of <br /> Pleasanton was to be fulfilled; and <br /> <br />WHEREAS: The interests of the City of Pleasanton in realigning <br /> Bernal Avenue and in developing and constructing a Civi( <br /> Center appear clearly to be served by said proposed <br /> agreement; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. That the appropriate City officers be authorized and <br /> directed to sign and execute the agreement between the <br /> Roman Catholic Bishop of Oakland and the City of <br /> Pleasanton as proposed by staff. <br /> <br /> 2. That the City Attorney be authorized to dismiss the <br /> condemnation suit filed against the Roman Catholic <br /> Bishop when satisfied that the agreement provided for <br /> herein has effectively removed the need therefor. <br /> <br />ATTEST: <br /> <br />HELE~6% McCARTY, CitY Clerk <br /> APPROVED AS TO FOR]~ <br /> <br />BERNAHD T.
