CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br />R~.,SOLUTiON NO,69'13~ <br /> <br />AUTHORIZING PAYMENT TO JAMES E~K~INEERING CONSTRUCTION <br />COMPANY ON HUD WATER MAIN PRO~CT WS~6'05L0245 <br /> <br />WHEREAS: <br /> <br />WHEREAS: <br /> <br />WHEREAS: <br /> <br /> Construction work by James Engineering Construction <br /> Company on Housing and Urban Development Water Main <br /> Project No. WS-6-05-0245 has been completed; and <br /> <br /> It appears that those delays in construction which did <br /> occur are attributable to unforeseeable wet weather and <br /> to several additions to the basic contract; and <br /> <br /> The construction has proceeded to completion in a satis- <br /> factory manner and has been inspected by the Department <br /> of Public Works of the City of Pleasanton and has been <br /> operating satisfactorily for several weeks. <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. That construction of Housing and Urban Development Water <br /> <br /> Main Project No. WS-6-05-0245 by James Engineering <br /> Company be accepted and a notice of completion filed. <br /> <br /> 2. That liquidated damages be waived. <br /> <br /> 3. That the Director of Finance be authorized and directed <br /> to issue to James Engineering Construction Company a <br /> warrant in the amount of $22,384,65, in satisfaction of <br /> City of Pleasanton's obligations on the basic contract <br /> and with respect to certain additions to the basic <br /> <br />contract. <br /> <br />DATED: June 9, 1969 <br /> <br />FORM <br /> <br /> <br />
