CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 69-262 <br /> <br /> APPROVAL OF CONTRACT OF SALE BETWEEN WESTERN PACIFIC <br /> RAILROAD COMPANY AND CITY OF PLEASANTON <br /> <br />~EREAS: The City of Pleasanton seeks to purchase for right-of-way <br /> purposes from the Western Pacific Railroad Company a <br /> parcel of land approximately one-half acre in size; and <br />~HEREAS: Suit in eminent domain was filed in the Superior Court of <br /> <br /> the County of Alameda on February 28, 1967 (36?466); and <br /> <br /> ~HEREAS: Following lengthy negotiations, a settlement acceptable <br /> to both parties was agreed upon, said settlement being <br /> evidenced by a contract of sale dated October 16, 1969 <br /> between the City of Pleasanton and the Western Pacific <br /> Railroad Company; and <br /> <br />kWMEREAS: Said Contract of Sale contemplates transfer by the Wester: <br /> Pacific Railroad Company to the City of Pleasanton of the <br /> parcel of land therein described in consideration of the <br /> City's assumption o£ the obligation to install street <br /> improvements adjacent the remaining parcels of Western <br /> Pacific Railroad Company. <br /> <br />WOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. That the agreement dated October 16, 1969 between the <br /> City of Pleasanton and Western Pacific Railroad Company, <br /> relating to the acqula~tion of a parcel of property <br /> necessary For the realignment of Bernal Avenue, is ap- <br /> proved and the appropriate City officers authorized and <br /> directed to sign said agreement and take whatever steps <br /> necessary to implement same. <br /> <br />DATED: November <br /> <br />ATTEST: <br /> <br />WILLIAM A.
