WHEREAS: <br /> <br />WHEREAS: <br /> <br />~HEREAS: <br /> <br /> CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 69-249 <br /> <br /> ELIMINATION OF CONDITION NO. 17, CONTAINED IN PLANNING <br /> COMMISSION RESOLUTION NO. 69-763' APPROVING THE PLANNED <br /> UNIT DEVELOPMENT FOR TRACT NO. 3004 (VALLEY TRAILS) <br /> <br />The approval of the Planned Unit Development for Tract <br />No. 3004 (Valley Trails) allowed elimination of public <br />sidewalks on one side of the street within said develop- <br />ment, subject, however, to the developer being required <br />to install sidewalks if, in the opinion of the City, <br />such sidewalks were subsequently found to be necessary; <br />'and <br /> <br />It appears that elimination of public sidewalks on one <br />side of the street for all of Tract No. 3004 is an appro- <br />priate, innovative Planning device consistent with the <br />Linear Park which has been provided by the developer and <br />which provides an effective walk-way system and play ares <br />for children living within the development; and <br /> <br />It appears that persons buying homes in the development <br />have reIied upon representations that sidewalks would be <br />eliminated on one side of the street and have, to that <br />end, installed landscaping, sprinkler systems, and trees. <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1.
