CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br />~tEREAS; <br /> <br />WHEREAS; <br /> <br />;HEREAS; <br /> <br />RESOLUTION NO- 69-246 <br /> <br />CIVIL ANTI-TRUST SUIT AGAINST AUTOMOBILE MANUFACTUR- <br />ERSFOR CONSPIRING TO ELIMINATE SMOG CONTROL <br />DEVELOPMENT AND RESEARCH <br /> <br />It is understood that the Attorney General's office of <br />the State of California is contemplating the filing of ar <br />anti-trust suit against certain automobile manufacturers, <br />alleging a conspiracy on their part to impede development <br />of effective smog control devices; and <br /> <br />The City of Pleasanton is now and will increasingly in <br />the future be confronted with a serious air pollution <br />problem and feels it important that everything which <br />might more quickly promote development of effective <br />mechanical smog control devices be done; and <br /> <br />It is N~Zt that the action contemplated by the Attorney <br />General is consistent with the desire on the part of this <br />City to promote and support attempts to expedite develop- <br />ment of effective smog control devices. <br /> <br />IOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br />That the Attorney General of California, or any of his <br />authorized assistants or deputies, be authorized to take <br />such action on our behalf and in our name, as, in his <br />sole discretion, may be deemed appropriate in the prepar- <br />ation, filing, ser*£ce and prosecution of a Civil Anti- <br />trust Suit for damages and other legal recovery against <br />certain automobile manufacturers for conspiring to retar( <br />the introduction of smog control devices in the State of <br />California, and be it further resolved <br /> <br />That this authorization includes the authority to settle <br />such litigation on such terms as the Attorney General or <br />any of his authorized assistants or deputies may deem <br />appropriate, and to allocate to us our proper and <br />equitable share of any sum recovered as damages eleeptin[ <br />the amount of attorneys' fees, costs, and expenses in- <br />curred by the Attorney General, as determined or <br />approved by the Court, whether by settlement, suit, or <br />otherwise. <br /> <br />DATED: October 13, 1969 <br />ATTESTi: <br /> <br />, IUi VL "D AS TO FORM <br /> <br />WILLIAM A.
