CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTI(~N NO. 69-230 <br /> <br />MEMORIALIZATION OF UNITED STATES JUSTICE DEPARTMENT WITH <br /> <br />RESPECT TO PENDING ANTI-TRUST SUIT AGAINST AUTOMOBILE <br />MANUFACTURERS IN CONNECTION WITH SMQG CONTROL DEVICES <br /> <br />~EREAS, <br /> <br />WNEREAS, <br /> <br />; 0W, <br /> <br /> The City of Pleasanton is in receipt of a letter, togethe <br /> with background informatio~ from Congressman George Brown <br /> 29th District, California, concerning the decision of the <br /> United States Justice Department to settle out of court <br /> a suit charging that major United States automobile <br /> makers conspired to delay the introduction of effective <br /> anti,pollution control de~ices; and <br /> <br /> It appears that such an out of court settlement is not in <br /> the pubIic interest in that it mitigates against the full <br /> facts of such allegSd, conspiracy being considered and <br /> passed upon by a competent court; and <br /> <br /> Full and complete knowledge of all of the facts relating <br /> to any aspect of the fight to control the pollution of <br /> our air is of considerable concern to the City of <br /> Pleasanton and, it is felt, to the citizens of the State <br /> of California and ef?.the United States. <br /> <br />TNEREFORE, BE IT RESOLVEB AS FOLLOWS: <br /> <br /> 1. That the City Council of the City of Pleasanton strongly <br /> urge the United States Justice Department to reconsider <br /> its decision to settle out of court the previously referr <br /> to anti-trust suit and to prosecute said case to the best <br /> of its ability in a court of law in order to determine, <br /> consistent with the Amemican Judicial process, not only <br /> the validity of the allegations of conspiracy contained <br /> in said suit, but also, so far as is possible, the valid- <br /> ity and feasibility of effective devices to control the <br /> <br /> <br />
