CiTY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br />RESOLUTION NO~ <br /> <br />FINDING AND DECLARING A PUBLIC NEED AND NECESSITY FOR ACQUIRING <br />AND CONSTRUCTIN0 A PUBLIC STREET ACROSS PORTIONS OF A DESCRIBED <br />PARCEL OF LAND WITHIN ~HE CITY OF PLEASANTON AND AUTHORIZING <br />INSTITUTION ON EMINENT DOMAIN PROCEEDINGS FOR ACQUIRING AND <br />POSSESSING CERTAIN REAL PROPERTY THEREFOR <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON THAT <br />IT HEREBY FINDS, DETERMINES AND DECLARES AS FOLLOWS: <br /> <br /> 1. The public interest convenience, need and necessity re- <br />Quire the acquisition, construction and completion by the City of <br />Pleasanton of dertain public improvements for public street pur- <br />poses, to wit: <br /> <br /> Relocation and realignment of a portion of the public <br /> street within the City of Pleasanton known as Ray Street <br /> in order that traffic traveling on Ray Street may proceed <br /> across its intersection with First Street and on to Vine- <br /> yawed Avenue without turning, and in order that the inter- <br /> section created by the confluence of Ray and First Streets <br /> and Vineyard Avenue be effectively sigmalized for the pro- <br /> tection of the health and safety of the residents of the <br /> City of Pleasanton. <br /> <br /> 2. That the public interest, convenience, need and necessity <br />require the acquisition by the City of Pleasanton for and in conne¢ <br />tion with said public improvements of the real property or interest <br />therein hereinafter described. <br /> <br /> B. The public interest, convenience, need and necessity <br />require that a fee simple estate be taken by the City of Pleasantor <br />in and to said real property hereinafter described. <br /> 4. The City Attorney is hereby authorized to take any and <br /> action necessary on behalf of the City of Pleasanton to acquire <br /> immediate possession of, and title to, said property hereinafter <br /> described by eminent domain proceedings or otherwise. <br /> <br /> 5. Said real property hereinabove referred to is more parti- <br /> cularly described as follows: <br /> <br /> Real property in the City of Pleasanton and County of <br /> Alameda, State of California, described as follows: <br /> See Exhibit "A" attached hereto and incorporated by <br /> reference herein as if fully set forth herein. <br /> <br />ATTEST: <br /> <br /> Wtl.
