WHEREAS: <br /> <br />WHEREAS: <br /> <br />WHEREAS: <br /> <br />WHEREAS: <br /> <br />WHEREAS: <br /> <br /> CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 70-111 <br />RE: RECONSIDERATION OF RESOLUTION NO. 70,110, AND <br /> AWARD OF CONTRACT FOR THE CONSTRUCTION OF <br /> FIRE STATION NO. 3 <br /> <br /> Bids were solicited and received in accordance with the <br /> Government Code procedure for the construction of Fire <br /> Station No. 3; and <br /> <br /> It appearing that the City of Pleasanton would not have <br /> sufficient funds to staff and operate said fire station <br /> upon completion thereof, Resolution No. 70-110 was <br /> adopted rejecting all bids; and <br /> <br /> Et appeared in the opinion of bond counsel and the City <br /> attorney that to construct the fire station and then <br /> lea~e it vacant or use it temporarily for some other <br /> City purpose would be permissible and, further, that the <br /> low bid was some $18,000 under the architect's estimate; <br /> and <br /> <br /> Reconsideration of the action taken in Resolution <br /> <br /> No. 70-110 was placed on the agenda with consent of the <br /> Council May 18, 1970. <br /> <br /> No vested rights had intervened herein between May ll <br /> and May 18, 1970, and the low bidder on said project, <br /> Leitze Construction Co. remained willing to enter into a <br /> contract with the City. <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> 1. <br /> <br />e <br /> <br />That the provisions of Resolution No. 70-110 are <br />rescinded. <br /> <br />That a contract for construction of Fire Station #3 is <br />awarded to the low bidder, Leitze Construction Company, <br />said contract to be for $150,386.00, the amount of the <br />1OW bid. <br /> <br /> <br />
