WHEREAS, WHEREAS, CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 71-56 RE: APPROVAL OF AGREEMENTS IMPLEMENTING DETACHMENT FROM THE VALLEY COMMUNITY SERVIOES DISTRICT OF THE AREA WITHIN ANNEXATIONS NO. 53 AND NOi 56 TO PLEASANTON the City of Pleasanton and Valley Community Services District have reached an accord with respect to imple- mentation of detachment of the area within annexations No. 53 and 56 from VCSD, said accord being represented by several agreements which said agreements as then written were approved by the City Council at its meeting January 18, 19?l by Resolution No. 71-13; and, since the adoption of Resolution No. 71-13 several minor changes have been made in some of the agreements therein approved thus requiring reiteration thereof by the City Council; and, WHEREAS, all of said agreements presently worded appear acceptable and desirable to the City of Pleasanton in that they will if approved, satisfy the condition of approval of the detachment herein imposed by the ~ocal Agency ~rmation Commission; and, WHEREAS, while negotiations for detachment herein have been pendin~ water connection and service fees have been collected by the City of Pleasanton and it appears desirable that staff be authorized to pay, to the extent available, said funds toward satisfaction of the City's obligations under the Water Rights Refund Agreement; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The proposed MODIFICATION OF AGREEMENT dated March 22, ,~ 1971, between Valley Community Services Distric~ and the City of Pleasanton modifying an earlier agreement ~ "'*dated June 14, 1967 providing for retention of ownership by Valley Community Services District of a portion of its 24 inch trunks line is hereby approved.
