CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-028 <br /> <br />RESOLUTION DETERMINING THAT AN OFFICE <br />BUILDING IS AN APPROPRIATE LAND USE FOR <br />PROPERTY LOCATED AT 5075 HOPYARD ROAD <br /> <br />WHEREAS, Chamberlin Associates applied for design review approval to construct a 44,250 <br /> sq. ft., two-story office at 5075 Hopyard Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - I/C-O (Industrial, <br /> Commercial and Office); and <br /> <br />WHEREAS, <br /> <br />the Planning Commission denied the application and recommended that a study be <br />conducted to determine whether an office use was still an appropriate land use for <br />this site; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant filed an <br /> appeal of the Planning Commission's decision; and <br /> <br />WHEREAS, a duly noticed public heating was held before the City Council on April 3, 2001 on <br /> the appeal and the Planning Commission's recommendation; and <br /> <br />WHEREAS, <br /> <br />an Environmental Impact Report (EIR) was prepared in conjunction with PUD <br />approval for Hacienda Business Park and the proposed project is within the scope <br />of the EIR; therefore, no environmental document was prepared for this <br />application; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: An office building remains an appropriate land use for the site. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
