CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-026 <br /> <br />RESOLUTION AMENDING THE MASTER FEE <br /> <br />RESOLUTION NO. 92-100 TO INCREASE THE IMPOUND <br />VEHICLE RELEASE FEE <br /> <br />WHEREAS, on May 19, 1992, the City Council adopted Resolution No. 92-100 which <br /> established a new Master Fee Schedule; and <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />Sections 22651 and 14602.6 of the California Vehicle Code authorize law <br />enforcement agencies to impound vehicles in enumerated circumstances; and <br /> <br />Section 11.40.010 of the Pleasanton Municipal Code provides that the Police <br />Department may impound vehicles in enumerated circumstances, including those <br />in Section 22651 of the California Vehicle Code; and <br /> <br />WHEREAS, <br /> <br />Section 22850.5 of the California Vehicle Code provides that a local agency may <br />seek by regulation, ordinance, or resolution recovery for the administrative costs of <br />a law enforcement agency when the agency impounds vehicles; and <br /> <br />WHEREAS, <br /> <br />Section 11.40.100 of the Pleasanton Municipal Code provides that, in addition to <br />satisfying requirements of the Califomia Vehicle Code, the owner of any vehicle <br />towed pursuant to enumerated sections of the California Vehicle Code shall pay to <br />the City of Pleasanton an administrative fee as established by City Council <br />resolution and that the owner shall pay this fee prior to the release of the vehicle; <br />and <br /> <br />WHEREAS, <br /> <br />the average administrative costs associated with the removal, storage, impound, <br />and release of a vehicle towed pursuant to the Pleasanton Municipal Code equal <br />approximately $100.00, although the fee provided for the release of impounded <br />vehicles in the Master Fee Schedule is $10.00. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
