CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 71-99 <br /> <br />COMMENDATION IN CONNECTION WITH <br />PARK DEDICATION CASE <br /> <br /> <br /> <br />WHEREAS~ the California Supreme Court on April 26, 1971, handed <br /> <br />down its opinion in the case of Associated Home Builders <br /> <br />of the Greater East Bay vs City of Walnut Creek upholding <br /> <br />in every respect the contentions of the City of Walnut <br /> <br />Creek with respect to the constitutionality of the State <br /> <br />Park Dedication law and their rights thereunder; and <br /> <br />WHEREAS, said opinion of the California Supreme Court was the <br /> <br />culmination of some four years of burdensome, expensive, <br /> <br />time consuming litigation; and <br /> <br />WHEREAS, the Cities of Pleasanton and Livermore filed Amicus Curia~ <br /> <br />briefs before both the Court of Appeal and the California <br />Supreme Court in support of the position taken by the Cit~ <br />of Walnut Creek and in behalf of some 55 cities and <br /> <br /> counties throughout the State of California. <br /> <br />iNOW, THEREFORE BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1 That the City Council of the City of Walnut Creek and,t <br /> · ~ <br /> in particular, its City Attorney Daniel Curtin be commended <br /> for their endurance, perseverance and expertise in carrying <br /> this litigation of state and nationwide importance to suc~ <br /> <br />a successful conclusion. <br /> <br />2.
