HIRST, City Attorney <br />Date 7/23/71 <br /> <br />RE: <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />NOW, <br /> <br /> APPEAL FROM GRANTING OF CONDITIONAL USE PERMIT <br /> FOR ARCO SERVICE STATION AT CORNER OF HOPYARD <br /> AND LOS POSITAS ROAD <br /> <br />the Planning Commission, at its meeting May 11, 1971, did, <br />by Resolution 1086, following a public hearing at which <br />evidence both oral and documentary was taken and considered, <br />grant to Singer Housing Company a conditional use permit <br />subject to some 27 conditions; and <br />the action of the Planning Commission was appealed and a <br />hearing noticed before the City Council at which said <br />hearing,a consequent study session, and continued public <br />hearing evidence both oral and documentary was taken and <br />considered; and <br />said evidence tended to indicate that until the Los Positgs/ <br />Route 680 interchange or overpass is constructed an addi- <br /> <br /> tional gas station at the corner of Los Positas Boulevard <br /> and Hopyard Road might not be economically feasible and <br /> to the extent not so feasible would, in the ordinary <br /> course of things, tend to deteriorate, thus having an ad- <br /> verse effect upon the value of surrounding properties and <br /> would eventually, because of its prominent location with- <br /> in the City, have an adverse effect upon the City as a <br /> whole. <br /> <br /> THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> The Conditional Use Permit granted Singer Housing Company <br /> by Planning Commission Resolution No. 1086 is hereby <br /> modified by the addition thereto of Condition #28, said <br /> condition to provide as follows: <br /> <br /> "The gas station contemplated herein shall be con- <br /> structed only concurrently-with or following con- <br /> struction of the Los Posit~aS./Rqete 680/~jnterchange <br /> or overpass." ~ <br /> <br /> ! ,'7 ,'~/-/¢..
