CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-011 <br /> <br />RESOLUTION APPROVING THE ABANDONMENT OF AN <br />ACCESS EASEMENT WITHIN THE BERNAL CORPORATE <br />PARK DEVELOPMENT <br /> <br />WHEREAS, in 1982, the City of Pleasanton entered into a Settlement Agreement with the <br /> developers of the Fromm Business Park (now Bemal Corporate Park); and <br /> <br />WHEREAS, the agreement granted the City a temporary access easement for the sanitary sewer <br /> pump station located in the northwest comer of the development; and <br /> <br />WHEREAS, <br /> <br />the easement rights automatically terminated upon the dedication of public streets <br />providing access to the pump station, but the Agreement requires formal <br />abandonment to remove the encumbrance of record; and <br /> <br />WHEREAS, <br /> <br />the pump station now has access from Koll Center Parkway and the successor in <br />interest of the original developer has requested the City to formally abandon the <br />easement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves the attached deed, abandoning the City's access easement within Bemal <br />Corporate Park, and authorizes the City Manager to execute all necessary <br />documents. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEET1NG HELD ON FEBRUARY 6, 2001 BY THE FOLLOWING VOTE: <br /> <br /> <br />
