CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 72-61 <br /> <br />WHEREAS, the sewer treatment plant of the City of Pleasanton has <br /> been, for the last several months, subjected to a cease <br /> and desist order issued by the Regional Water Quality <br /> Control Board; <br /> WHEREAS, removal of said cease and desist order is imminent; <br /> <br />WHEREAS, City has, consistent with and pursuant to a joint exercise <br /> of powers agreement entered into in 1967 with Valley Com- <br /> munity Services District, pursued a course of action to <br /> gradually phase out its sewer treatment plant; <br /> <br />WHEREAS, it is desireable to conserve the capacity remaining in <br /> said sewer treatment plant in order that the ability of <br /> said sewer treatment plant to absorb additional connec- <br /> tions be effectively gauged so as to, so far as possible, <br /> avoid substantial additional expenditures on said sewer <br /> treatment plant during its phase-out period; <br /> <br />WHBREAS, the City Manager has proposed an administrative mechanism <br /> including a formula pursuant to which pending and yet to <br /> be applied for building and sewer connection permits <br /> would be issued upon the lifting of the cease and desist <br /> order herein referred to; <br /> <br />WHEREAS, said formula appears under the circumstances to be fair <br /> <br /> and equitable; <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. That the administrative mechanism described in the report <br /> to the City Manager dated April 24, 1972, attached hereto <br /> designated Exhibit "A" and incorporated fully by reference <br /> herein, be adopted and relied upon by all affected City <br /> officers in administering the processing and granting of <br /> building and sewer connection permits when and if the <br /> <br /> <br />
