CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> RESOLUTION NO. 73-94 <br /> <br />RE: CIVIL SUIT AGAINST CITY OF PETALUMA, CALIFORNIA <br /> <br />WHEREAS, the City of Petaluma adopted a controlled growth ordinarne <br /> limiting the number of dwelling units which may be con- <br /> structed within its corporate limits; and <br /> <br />WHEREAS, the City of Petaluma was sued in Federal District Court <br /> in an action entitled Construction I'ndustr~zl Association <br /> of Sonoma County, et al, vs. The City Of Petaluma, Civil <br /> Action No. C-73-0663, challenging the validity of the <br /> city's controlled growth ordinance; and <br /> <br />WHERFAS, the City of Pleasanton is interested in supporting the <br /> action of the City of Petaluma in defending the above <br /> mentioned lawsuit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED By THE CITY COUNCIL 6F THE CITY OF <br />PLEASI&NTON AS FOLLOWS: <br /> <br />SECTION 1. The City of Pleasanton is desirous of s~oE~ing the <br /> City of Petaluma in Federal District Court Action entitled <br /> COnstruction Industry Association;Of Sonoma County, 'etal <br /> vs. The City of Petaluma, ~il Action No. C-73'0643, <br /> contesting the validity 0~ the City's controlled growth <br /> ordinance. <br /> <br />SECTION 2. The City of Pleasanton hereby pledges the S~m of One <br /> Hundred Dollars ($100.00) as assistance to the City of <br /> Petaluma to help defray the cost of litigation involving <br /> <br />the City of Petaluma's controlled growth ordinance. <br />SECTION 3. The Finance Officer is hereby directed to appropriate <br /> <br /> the sum of $100.00 to the City Attorney's budget for use <br /> <br /> in regard to litigation on behalf of the City of Petaluma. <br /> <br /> SECTION 4. The City Attorney is hereby directed to participate <br /> with the City of Petaluma to the extent that he deems <br /> necessary and desirable. <br /> <br /> <br />
