CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 73-122 RE: SUSTAINING THE APPEAL OF J. A. JENKS COMPANY FROM A DECISION OF THE DIPaCTOR OF COMMUNITY DEVELOPMENT REGARDING AN ENVIRONMENTAL IMPACT REPORT DETERMINATION WHEREAS, the Director of Community Development pursuant to the EnVironmental Impact Guidelines and Procedures adopted by Resolution No. 73-58 determined that an environmental impact report was required for a project to be located at the northeast corner of Mohr Avenue and Oakland Avenue, the applicant being J. A. Jenks Company; and WHEREAS, subsequent to ~he Community Development Directors decisior and pursuant to S63 of the above mentioned guidelines and procedures, J. A. Jenks Company within the 10-day appeal period appealed the Community Development Director's decision that an environmental impact report fer its project to the City Council; and WHEREAS, a public hearing was held by the City Council of the City of Pleasanton on July 16, 1973, at 30 West Angela Street, Pleasanton, at 8:00 P.M.; and WHEREAS, the City Council considered a staff report relating to the Community Development Director's determination that an environmental impact report was required, as well as per- ti~ent testimony offered by the J. A. Jenks Company; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE AS FOLLOWS: 1. The appeal of J. A. Jenks Company of the Community Development Director's determination that an environmental report was required for its project to be located on the northeast corner of Mohr Avenue and Oakland Avenue in Pleasanton is hereby sustained. 2. The City Council has determined that the project in question will not have a significant effect on the en- vironment according to the criteria established by
