CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 73-122 <br /> <br /> RE: SUSTAINING THE APPEAL OF J. A. JENKS COMPANY FROM <br /> A DECISION OF THE DIPaCTOR OF COMMUNITY DEVELOPMENT <br /> REGARDING AN ENVIRONMENTAL IMPACT REPORT DETERMINATION <br /> <br />WHEREAS, the Director of Community Development pursuant to the <br /> EnVironmental Impact Guidelines and Procedures adopted <br /> by Resolution No. 73-58 determined that an environmental <br /> impact report was required for a project to be located at <br /> the northeast corner of Mohr Avenue and Oakland Avenue, <br /> the applicant being J. A. Jenks Company; and <br /> <br />WHEREAS, subsequent to ~he Community Development Directors decisior <br /> and pursuant to S63 of the above mentioned guidelines and <br /> procedures, J. A. Jenks Company within the 10-day appeal <br /> period appealed the Community Development Director's <br /> decision that an environmental impact report fer its <br /> project to the City Council; and <br /> <br />WHEREAS, a public hearing was held by the City Council of the City <br /> of Pleasanton on July 16, 1973, at 30 West Angela Street, <br /> Pleasanton, at 8:00 P.M.; and <br /> <br />WHEREAS, the City Council considered a staff report relating to the <br /> Community Development Director's determination that an <br /> environmental impact report was required, as well as per- <br /> ti~ent testimony offered by the J. A. Jenks Company; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br /> 1. The appeal of J. A. Jenks Company of the Community <br /> Development Director's determination that an environmental <br /> report was required for its project to be located on the <br /> northeast corner of Mohr Avenue and Oakland Avenue in <br /> Pleasanton is hereby sustained. <br /> <br /> 2. The City Council has determined that the project in <br /> question will not have a significant effect on the en- <br /> vironment according to the criteria established by <br /> <br /> <br />
