de <br /> <br />Rendition of general consultation and advice to First <br />Party,~s officers, agents, or employees with respect <br />to the planning, preparation and handling o~ all engi- <br />neering phases of the aforesaid proceedings; <br /> <br />Attendance at such conferences and public meetings with <br />First Party as may be reasonably necessary to perform <br />this contract of employment. <br /> <br />3. Second Party shall receive compensation for the above Services <br /> <br />as follows: <br /> <br />(a) <br /> <br />7.0% of the construction cost (including contingencies) <br />for completion of the plans and specifications, payable <br />upon receipt of the proceeds of assessments collected <br />and/or bonds sold, but the amount subject to adjustment <br />until completion of construction; <br /> <br />(b) <br /> <br />3.0% of the construction cost for construction staking and <br />job coordination, payable upon completion of construction <br />(not including inspection); <br /> <br /> (c) 1.5% of the construction cost for the assessment proceedings <br /> required of the Second Party, payable upon receipt of the <br /> proceeds of assessments collected and/or bonds sold; <br /> <br /> (d) $4,000.00 lump sum for extraordinary preliminary engineer- <br /> ing services, payable upon receipt of the proceeds of <br /> assessments collected and/or bonds sold. <br /> <br />'The above amount shall be paid by First Party out of the proceeds <br /> <br />of assessments levied and bonds to be issued in said proceedings. ' ' <br /> <br /> 4. In the event said proceedings are not carried through to <br />conclusion, or shall be abandoned, then Second Party shall receive <br />nothing. <br /> <br /> 5. In consideration of Second Party's fee for services, First ' <br />Party agrees that the Second Party will perform no on-site construction. <br /> <br />review for this project; that such services will be provided by others. <br /> <br /> 6. First Party agrees that in accordance with generally accepted <br /> <br />construction practices, the construction contractor will be required <br /> <br />to assume sole and complete responsibility for job site conditions <br />during the course of construction of the project, inciuding safety <br /> <br />of all persons and property; that this requirement shall be made to <br /> <br />apply continuously and not be limited to normal working hours. <br /> <br />-2- <br /> <br /> <br />
