Rendition of general consultation and advice to First <br />Party, its officers, agents, or employees with respect <br />to the planning, preparation and handling of all engi- <br />neering phases of the aforesaid proceedings; <br /> <br />e% <br /> <br />Attendance at such conferences and public meetings with <br />First Party as may be reasonably necessary to perform <br />this contract of employment. <br /> <br />3. Second. Party shall receive compensation for the above services <br /> <br />as follows: <br /> <br />(a) <br /> <br />6.5% of the construction cost (including contingencies) <br />for completion of the plans and specifications, payable <br />upon receipt of the proceeds of assessments collected <br />and/or bonds sold, but the amount subject to adjustment <br />untilcompletion of construction; <br /> <br />'(b) <br /> <br />3.0% of the construction cost for construction staking <br />and job coordination, payable upon completion of construc- <br />tion (not including inspection); <br /> <br />(c) 2.0% of the construction cost for the assessment proceed- <br /> ings required of the Second Party, payable upon receipt <br /> of the proceeds of assessments collected and/or bonds sold. <br /> <br />(d) lf0% of the land acquisition cost for the assessment <br /> proceedings required of the Second Party; payable upon <br /> receipt of the proceeds of assessments collected and/or <br /> bonds sold. <br /> <br /> The above amounts shall be paid by First Party out of the proceeds <br />of assessments levied and bonds to be issued in said proceedings. <br /> <br /> 4. In the event said proceedings are not carried throughto <br /> <br />conclusion, or shall be abandoned, then SecOnd Party shall receive nothing. <br /> <br /> 5. In consideration of Second Party's fee for services, First <br /> Party agrees that the Second Party will perform no on-site construction <br /> review for this project; that such services will be provided by others. <br /> <br /> 6. First Party agrees that in accordance with generally accepted <br />constructio~ practices, the construction contractor will be required <br />to assume sole and complete responsibility for job site conditions <br />during the course of construction of the project, including safety of <br />all persons and property; that this requirement shall be made to apply <br />continuOuSly and not be 1h~lited to normal working hours. <br /> <br /> <br />
