CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-148 <br /> <br />RESOLUTION APPROVING SECOND SUPPLEMENTAL <br />AGREEMENT FOR WASTEWATER DISPOSAL SERVICES <br />WITH DSRSD <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton and Dublin San Ramon Services District (DSRSD) are <br />operating under an agreement ("the Basic Agreement") for wastewater treatment <br />and disposal consisting of an "Agreement for Wastewater Disposal Services" dated <br />November 3, 1992 and a "First Supplemental Agreement to Agreement for <br />Wastewater Disposal Services" dated September 2, 1997; and <br /> <br />WHEREAS, under the terms of the Basic Agreement, the parties may make supplemental <br /> agreements from time to time as necessary; and <br /> <br />WHEREAS, <br /> <br />the attached "Second Supplemental Agreement" is necessary to modify the flow <br />allocations and transfer provisions in the Basic Agreement to include the <br />LAVWMA Project and DSRSD's wastewater treatment plant expansion project; <br />and <br /> <br />WHEREAS, <br /> <br />at its meeting of December 5, 2000, the City Council received the report of the <br />Director of Public Works (SR 00:328) regarding the Second Supplemental <br />Agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves the Second Supplemental Agreement, a copy of wttich is attached hereto <br />and incorporated herein by this reference, and authorizes the Mayor to execute the <br />Second Supplemental Agreement. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
