CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-130 <br /> <br />RESOLUTION DECLARING A VACANT PARCEL IN THE <br />4100 BLOCK OF STANLEY BOULEVARD AS SURPLUS <br /> <br />WHEREAS, the City has a fee imerest in vacant land in the 4100 block of Stanley Boulevard, <br /> ~vhich it acquired for siroct purposes but which is no longer needed for sweet <br /> purposes; and <br /> <br />WHEREAS, at its meeting of November 7, 2000, the City Council reviewed a staff report from <br /> the Law Department (SR 00:281) concerning whether this property should be <br /> declared surplus; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Declares the vacant parcel in the 4100 block of Stanley Boulevard as surplus. <br /> <br />Section 2: <br />Section 3: <br /> <br />Section 4: <br />Section 5: <br /> <br />Detem~ines that file fair market value for the parcel shall be the average of the <br />price the City paid for the property (in 2000 dollars) and an appraised value. <br /> <br />The City shall notify all public agencies, required by law to be given first <br />opportunity to purchase surplus property, that the City has declared this parcel <br />surplus and oll~r to sell the parcel to such agencies. <br /> <br />The City finds that the tnost appropriate disposition of the parcel is to sell the <br />parcel to the property owner to the north of the parcel, provided that the owner of <br />the parcel to the north is willing to pay the fair market value as stated above. <br /> <br />If no public agency wishes to purchase the property, the City Manager is <br />authorized to prepare a Parchase and Sales Agreement with Phil Ciesielski (the <br />property owner to the north), which Agreement shall be returned to Council for <br />f'mal action, and which shall set forth the various restfictions as to the use of the <br />property, payment schedule, merging of the property with the property to the north, <br />setback requirements frotn the Arroyo, etc. <br /> <br />Section 6: This resolution shall become elective immediately upon its passage and adoption. <br /> <br /> <br />
