CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-128 <br /> <br />RESOLUTION REQUESTING THAT LAFCO APPROVE AN <br />EXTENSION OF TIME UNTIL JUNE 30, 2001 TO <br />COMPLETE THE HAPPY VALLEY ANNEXATION <br /> <br />WHEREAS, on September 15, 1998, the City Council of the City of Pleasanton adopted <br /> Resolution No. 98-128 initiating an annexation application to the Local Agency <br /> Formation Commission (LAFCo) for an 811+ acre area of unincorpurated territory <br /> located south of Sycamore Road, east of Rosepoint and Carriage Gardens <br /> neighborhoods, west of Foley Ranch, and north of Koopman Ranch; and <br /> <br />WHEREAS, on March 11, 1999, LAFCo adopted its Resolutions Nos. 99-01 and 99-02, <br /> approving the proposed annexation of territory known as "Happy Valley"; and <br /> <br />WHEREAS, <br /> <br />on July 20, 1999, and July 29, 1999, the City Cotmcil held public hearings on the <br />annexation, and written protests were filed by at least 25% (but less than 50%) of <br />the registered voters residing in the affected territory. This level of protest <br />required that a special election be held to confirm the annexation, and the City <br />Council set the election for November 1999; and <br /> <br />WHEREAS, <br /> <br />the Council has been forced to delay the special election on several occasions <br />during the past twelve months because of uncertainty regarding the federal and <br />state environmental permits for the proposed municipal golf course in the Happy <br />Valley area; and <br /> <br />WHEREAS, <br /> <br />despite continued efforts to obtain federal and state environmental permits for the <br />project, uncertainty still remains whether the City can secure the necessary <br />permits, and the City Council considers it prudent to again postpone the election <br />until more assurance can be provided to voters regarding the status of the proposed <br />municipal golf course; and <br /> <br />WHEREAS, pursuant to California Government Code §57001, the City had one year from the <br /> date of LAFCo approval to complete the annexation proceedings; and <br /> <br />WIIEREAS, Califomia Government Code §57001 permits LAFCo to authorize an extension of <br /> time for the completion of the annexation proceedings; and <br /> <br /> <br />
