City shall waive its Lower Income Honsing Fee for all 581 units and for the <br />commemial/retall portion of the project,, shall waive its Public Facility, Traffic <br />Development and In Lieu Park Dedication Fees for the 87 units described in Sections 1 <br />and 2, and shall waive City water and sewer connection fees, as well as City Building <br />Planning and Public Works inspection and processing fees, lbr the 56 for sale units and <br />for the 20 apartment units available for households with incomes at 50% of the Area <br />Median Income. <br /> <br />City shall, with Developer's cooperation, assume the responsibility to market the for sale <br />units. Developer, with City's cooperation, shall assume the responsibility to market the <br />rental units. <br /> <br />The for sale units described herein will be subject to the standard provisions of the C ity's <br />home ownership assistance program, including resale restrictions, said provisions to be <br />entbrced through deed restrictions recorded against each properly. <br /> <br />City may elect to utilize its Lower Income Housing Fund (or other funding sources) to <br />buy additional units or to make the units more affordable than as provided under this <br />Agreement. Developer shall cooperate with City in these efforts. <br /> <br />7.
