CITY COUNCIl, OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-113 <br /> <br />RESOLUTION APPROVING THE AFFORDABLE HOUSING <br />AGREEMENT BETWEEN THE CITY OF PLEASANTON <br />AND GHC BERNAL INVESTORS, LLC (GREENBRIAR <br />ItOMES COMMIYNITIES, INC.) REGARDING TIlE BERNAL <br />PROPERTY PROJECT <br /> <br />WHEREAS, <br /> <br />Ordinance No. 1488 of the City of Pleasanton sets forth a Lower-Income ltousing <br />Fee requirement to support an affordable housing program (at Chapter 17.40 of the <br />Pleasanton Municipal Code) which authorizes the City to enter into regulatory <br />agreements with developers to exempt projects from the lower-income housing fee <br />if the projects provide fifteen percent (15%) of its residential units at affordable <br />levels; and <br /> <br />WHEREAS, GHC Bernal Investors LLC CGHCBI") has made an application to the City for an <br /> Affordable ttousing Agreement for the Bernal Property project; and <br /> <br />WHEREAS, the City certified a Final EIR for the Bernal Property project; and <br /> <br />WHEREAS~ a duly noticed public hearing concerning the Affordable Housing Agreement was <br /> held by the City Council on August 21, 2000; and <br /> <br />WHEREAS, <br /> <br />the City Council considered all the infonnation presented at the public hearing by <br />GHCBI, stafl; and members of the public regarding the terms of the Affordable <br />Housing Agrcctnent. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Fiuds that the proposed Affordable Housing Agreement between the City of <br />Pleasm~ton and GHC Boreal Investors, LLC is consistent with the City's General <br />Plan, the Bemal Property Specific Plan, and the objectives of the Lower-Income <br />Housing Fee ordinance and the City's affordable housing policies. <br /> <br /> <br />
