Box 520 <br />Pleasanton, CA 94566 <br /> <br />GROWTH MANAGEMENTAGREEMENT <br /> <br />August 18, 2000 <br /> DRAFT <br /> <br /> THIS GROWTH MANAGEMENT AGREEMENT (the <br />"Agreement") is made .2000 between the GHC BERNAL INVESTORS, <br />LLC ("Developer") and the CITY OF PLEASANTON, a municipal corporation <br />CCity"). <br /> <br />RECITALS: <br /> <br /> A. Developer owns certain real property (the "Subject <br />Property") located in the City of Pleasanton and within <br />unincorporated Alameda County, as described in Exhibit "A," <br />attached to this Agreement and made a part of it by reference. <br /> That portion of the Subject Property currently within <br />unincorporated Alameda County is proposed by the Parties to be <br />annexed to the City of Pleasanton. <br /> <br /> g. This Agreement is one element of various development <br />approvals granted by City (collectively the "Initial Project <br />Approvals") vesting in Developer the right to build on the <br />Subject Property up to 581 residential units, up to 750,000 <br />square feet of commercial space and various other improvements <br />(collectively the "Project"). A portion of the residential <br />units shall be market rate housing and a portion shall be <br />affordable housing (as defined heroin). <br /> <br /> C.
