CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> RESOLUTION NO. 94-139 <br /> <br /> RI~OLUTION SUPPORTING THE DISSOLUTION OF THE <br /> TRI-VALLEY WASTEWATER AUTHORITY <br /> <br />WHEREAS the City of Pleasanton, the City of Livermore, the Dublin San Ramon Services <br /> District (DSRSD) and the County of Alameda have entered into a Joint Powers <br /> Agreement (IPA) and formed the Tri-Valley Wastewater Authority CYWA); and <br /> <br />WHEREAS the TWA was formed for the prima~ purpose to build a new project to meet the <br /> wastewater disposal needs of the Tri-Valley; and <br /> <br />WHEREAS those efforts have now been assumed by the Livermoro-Amador Valley Water <br /> Management Agency (LAVWMA) of which Pleasanton, Livermore and DSRSD <br /> are member agencies; and <br /> <br />WHEREAS, on October 19, 1994, the TWA B~ard members referred to each of the member <br /> agencies the issue as to whether TWA should continue in existence; and <br />WHEREAS, on November 15, 1994, thePle~nton City Councilconsidered the Public Works <br /> Director's staff report (SR 94:386) concerning dissolving TWA; and <br />WHEREAS, the Council took public input concerning this maRer; <br /> <br />NOW, THI~REFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council supports the dissolution of TWA. <br /> <br />Section 2: If TWA cannot be dissolved because one or more parties to the TWA JPA do not <br /> agree to the dissolution, then the City Council supports Pleasanton's withdrawal <br /> from TWA, as provided for in the JPA, if Livemore and DSRSD likewise agree <br /> to withdraw from TWA. <br /> <br />Section 3: The Pl~n~nnton representatives to TWA are directed to present this position to the <br /> full TWA board at the next scheduled TWA meeting. <br /> <br /> <br />
