CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA AS BOARD OF DIRECTORS OF THE OAK TREE FARM GEOLOGIC HAZARD ABATEMENT DISTRICT RESOLUTION NO. 94-137 RESOLUTION DECLARING THE BOARD'S INTENllON TO APPROVE ASSESSMENTS WflHIN THE OAK TREE FARM GEOLOGIC HAZARD ABA'He;MENT DISTRICT WHEREAS, on November 15, 1994, the City Council of the City of Plumton adopted Resolution No. 94-135, approving the formation of a geologic baTnrd abatement district ("GHAD") for the Oak Tree Farm project area and appointing the City Council as the Board of Dimmrs for the GHAD; and in order to defray the costs and expenses of maintaining and operating CHAD improvements, it will be necessary to provide for a reliable source of GIIAD f~nding; and Public Resources Code Section 26650 et sea. authorize, after public hearing, the levy and collection of assessments upon benefitted pwperty within the GHAD to pay for the maintenance and operation of GHAD improvements; and WHEREAS, attached hereto as ~ is a report prepared for the Board which sots forth the estimated budget for the 1994-95 fiscal year, the proposed estimated assessments to be levied each fiscal year against each parcel of property (single- family residential lots) within the CHAD, and a description of the method used in calculating the estimated assessments. The Board has reviewed and considered said report. NOW, TI-IEREFORE, THE BOARD OF DIRECTORS OF THE OAK TREE FARM GEOLOGIC HAZARD ABATEMENT DISTRICT RESOLVES AS FOLLOWS: Section 1: The Board hereby approves the report by the Engineer for the GHAD as set forth in ~, including the estimated GHAD budget for the 1994-95 fiscal year set forth therein. Section 2: The Board hereby declares its intention to order that the costs and expenses of maintaining and operating the GHAD improvements shall be assessed against the pwperty within the GHAD benefitted thereby.
