WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLLrFION NO. 94-135 <br /> <br />~-~OLUTION ORDERING THE FORMATION OF THE <br />OAK TREE FARM GEOLOGIC HAZARD ABATEMENT <br />DISTRICT <br /> <br />on October 18, 1994, pursuant to Section 26550 of the Public Resources COde, <br />this Council adopted Resointion No. 94-118A, declaring the Council subject to <br />the provisions of Division 17 (Section 26500 et se~.) of said COde, and forwarded <br />a copy of said Resolution to the State Controller; and <br /> <br />on October 18, 1994, this Council adopted Resolution No. 94-118B, initiating <br />proceedings for the formation of a geologic hazard abatement district ("CHAD") <br />for the Oak Tree Farm project area, setting a public hearing on the filed petition <br />for November 15, 1994, and directing that notice of the hearing be mailed in <br />accordance with the requirements of Public Resources COde Section 26561 to all <br />the owners of all the real property within the boundaries of the territory to be <br />included within the proposed CHAD; and <br /> <br />said notice of hearing was mailed to all said owners of real progeny in <br />accordance with Public Resources Code Section 26561, or, in lieu thereef, all <br />said owners of tea1 property submitted to the City Clerk written waivers of said <br />notice of hearing; and <br /> <br />at the time set for hearing, no owner qfreal property within the boundaries of the <br />proposed GHAD had made a written objection to its formation; and <br /> <br />it appeared at the hearing that the owners of more than 50 percent of the assessed <br />valuation of the proposed GHAD did not object to the formation thereof, and the <br />Council thereupon closed the hearing; and <br /> <br />the formation of the proposed GHAD is not subject to the California <br />Environmental Quality Act or the Cortese-Knox Local Government <br />Reorganization Act of 1985, in accordance with Public Resource COde Section <br />26559 and Section 26560; and <br /> <br />WHEREAS, the Council finds that the formation of the GHAD is in the interest of the public <br /> health, Safety and welfare; <br /> <br /> <br />
