CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLLrrION NO. 9~.-129 <br /> <br />A RESOLUllON FINDING 'IllAT LOWER-INCOME <br />HOUSING FLINDS ARE COMMITfle2D TO A PARTICULAR <br />PROJECT <br /> <br />WHEREAS, <br /> <br />Government Code §66001(d), effective January 1, 1989, requires the City to <br />make findings once each fiscal year with respect to any portion of a fee remaining <br />unexpended or uncommitted in its account five or more years after deposit of the <br />fee, and to identify the purpose to which the fee is to be put and to demonsIrate <br />a reasonable relationship between the fee and the purpose for which it was <br />charged; and <br /> <br />stuff has reviewed the development fees collected between January 1, 1989 and <br />June 30, 1989 to determine if any such development fees remain unexpended or <br />uncommitted; and <br /> <br />WHEREAS, staff has found that no development impact fees for this period remain <br /> anexpended or uncemmitted; and <br /> <br />WHEREAS, otherrcwenues, however, were received or generated bythe City'sLower-Income <br /> Housing Fund during this pedod; and <br /> <br />previously the City Council has made a commitment of $2.9 million to assist in <br />the construction of the Case Avenue project, a lower income housing project <br />scheduled to begin construction in 1994 or 1995; and <br /> <br />WHEREAS, <br /> <br />the $2.9 m~lion commitment exceeds the ~venues remaining in the Lower- <br />Income Housing Fund received or generals between January l, 1989 and <br />June 30, 1989; <br /> <br />NOW, THEREFOE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />The City Council finds as follows: <br /> <br />Affordable housing is needed to implement the goals and objectives of ~e <br />City's Housing Element of the General Plan; <br /> <br />The City's objective for meeting the lower income housing needs <br />identified in the City's General Plan, caused by the developmeat of <br />residential, commewial and industrial land uses, can be assisted by the <br />monetary exaction of the lower-income housing fee on new development; <br /> <br /> <br />
