Box 520 <br />Pleasanton, CA 94566 <br /> <br />DRAFT AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into on the __ day of ,1994, <br />by and between the PLEASANTON UNIFtgn SCHOOL DISTRICT, Alameda County, <br />California ("District"), and the CITY OF PLEASANTON, a municipal corporation ("City"). <br /> <br />RECITALS: <br /> <br /> A. The District owns a ~-2.55-acre parcel on Sycamore Road described in Exhibit "A" <br />attached to this Agreement and made a part of it be reference. This parcel has been declared <br />surplus. <br /> <br /> B. The City, with District assistance, prepared and adopted the North Sycamore <br />Specific Plan ("Specific Plan") to guide and facilitate the development of the Spe~t~c Plan area, <br />an area which includes the District's surplus site and adjoining properties. <br /> <br /> C. The Specific Plan sets forth detailed land us~ and circulation standards, Capital <br />improvement requirements, and regulatory schemes and policies to implement the plan -- all of <br />which contempla~ the coordinated development of twenty-nine separate proberiles containing <br />135 acres and up to 252 residential units. <br /> <br /> D. The City regulates new residential development through its Growth Management <br />Program in order to assure its citizens of a logical, orde~y growth pattern meeting its General <br />Plan policies. It allocates a project's dwelling units to calendar years in which building permits <br />will be issued, assuring that the City's General Plan growth policies are met. <br /> <br /> E. The Growth Management Program requires new residential projects seeking to <br />develop to have completed all preliminary, discretionary planning approvals prior to making an <br />application for approval. This requirement was instituted in order to better allow residential <br />developers to make an accurate assessment of the years when building permits would be issued <br />for dwelling units in their projects. <br /> <br /> F. The Specific Plan properties which require Growth Management Program approval <br />are the eight larger parcels and contain a potential total of 204 units.
