CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 94-118B RESOLUTION INITIATING PROCEEDINGS FOR THE FORMATION OF THE OAK TREE FARM GEOLOGIC HAZARD ABATEMENT DISTRICT (GHAD) WHEREAS. on October 18, 1994, pursuant to Section 26550 of the Public Resources Code, this Council adopted Resolution No. 94-118A, declaring that the Council is subject to the provisions of Division 17 (§26500 et sea.) of said Code, and forwarded a copy of said resolution to the State Controller; and WHEREAS pursuant to the provisions of said Division 17 of said Code, a petition was filed with the City Clerk, dated October 18, 1994, for the formation of a geologic ha'lard abatement district CGHAD") for the Oak Tree Farm project area; and WHEREAS said petition complies with the provisions of Public Resources Code §26552 and has attached to it a legal description of the boundaries of the territory to be included within the proposed CHAD (Exhibit "A"), a map showing the boundaries of the territory to be included within the proposed GHAD (Exhibit "B'), and a plan of control (E~; and WHEREAS the City Clerk has reviewed said petition and determined that it is substantially in the form described in Public Resources Code §§26551, 26552, and 26553, and verified that the signatures affixed to the petition represent the owners of all of the real property to be included within the proposed GHAD, and further verified that the signatures thereon were secured within [20 days of the date on Which the first signature on the petition was affixed and that said petition was submitted to the City Clerk within 30 days after the last signature was affixed; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: This resolution is made pursuant to Division 17 (§26500 et seu.) of the Public Resources Code. Section 2: The City Council has been presented with and has reviewed the plan of control submitted with the petition for the proposed CHAD and has determined that the public health, safety and welfare require formation of the CHAD.
