CITY COUNCIL OF THE CITY OF PLEASANTON ALANIRmA COUNTY, CALIFORNIA RESOLUTION NO. 94-113 RESOLUllON ORDERING $UDICIAL FORECLOSURE OF 1993-94DRL~IQUENT ASSESSMENTS PURSUANT TO 1HE I!VIt'Ic, OVEMENT BOND ACT OF 1914, AND ORDERING · IllAT 'l]:t~ TAX COLT~leETOR BE CI~RBt'i'W WI111 IIIOSE ASSESS~qRNTS XVHEREAS, the City of Ple~-ton ("City") has conducted special assessment, reassessment and refunding proceedings from time to tim resulting in the issuanc~ end sale of improverant bonds ("BOnds") pursuant to the provisions of the Improvement BOnd Act of 1915 and the Refunding Act of 1984 for 1915 Improvement Act BOnds (California Streets and Highways Code, Section 89500 et s~., end 950 et sen., collen~vely ("1915 Act"); and pursuant to the 1915 Act, the City has duly end reg,,l~rly issued and recorded the unpaid asseasments end reasseasments (collectively "Assessments'), which assessments and each installment thm~f and interest end penalties thereon constitute liens against the lots end parcels of land against which they we made, until the same are paid; end WHEiEAS, certain msments and installments thereof have not been paid when due, and cormln instaJlments of those asses~nents may not bo paid in the future; end pursuant te resolution adopted prior to the issuance of the bonds, under the provisions of Section 8830 Co) of the CaLifornia Streets end Highways Code, the City Council has covenanted for the benefit of bondholders to commence foreclosure actions in the Superior Court regarding delinqucot installments of eny assessments which secure the BOnds end to diligenfiy prosecute such actions; and WHEREAS, under the provisions of Section 8833 of the 1915 Act, when such foreclosure antion is ordered, the county tax collector is to be credited upon the assessment roll then hi his hands with the amount charged against him on account of the assessments to be sued on end to be relieved of further duty in regard thmto; NOW, TI-r~REFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City hereby orders that the delinquent assessment installments listed on Exhibit A attached hereto and incorporated herein, end all future installments of those assessments which are not paid when due, be collected by action brought in the Superior Court of Ahmeda County to foreclose the liens thereof.
