CiTY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 94-61 <br /> <br />RESOLUTION APPROVING THE 1994 WEED ABATEMENT <br />PROGRAIVI AND AUTHORIZING STAFF TO PROCEED <br />WITH ABATEbIENT OF WEEDS, RUBBISH OR REFUSE <br />UPON OR IN FRONT OF CERTAIN DESCRIBED <br />PROPER:tIES h'rIHIN THE CI:I'Y OF PLEASANTON <br />WINCH CONSTrrUTE PUBLIC NUISANCE <br /> <br />WItEREAS <br /> <br />at its meeting of April 5, 1994, Council adopted Resolution No. 94-34 declaring <br />as a public nuisance art weeds, rubbish or refuse upon or in front of certain <br />described properties within the City of Pleasanton as more particularly set forth <br />in Exhibit "A", attached thereto; and <br /> <br />WIIEREAS said Resolution No. 94-34 was adopted pursuant to the provisions of Government <br /> Code Sections 39501-39588; and <br /> <br />WHEREAS <br /> <br />said Resolution No. 94-34 designated May 17, 1994, at the hour of 7:00 p.m., <br />at the Pleasanton City Council Chambers, as the time, date and place to hear and <br />consider objections to the abatement and removal of weeds, rubbish or refuse <br />upon or in front of certain described properties within the City of Pleasanton <br />more particularly set forth in Exhibit "A" to Resolution No. 94-34; and <br /> <br />WIIEREAS <br /> <br />the Fire Inspector was charged with the responsibility to perform the duties <br />imposed by Government Code Sections 39560-39588, and he did prepare notices <br />to destroy weeds and remove rubbish and refuse, and did in the time and manner <br />proscribed by law cause copies of the notice to be conspicuously posted on or in <br />front of the property where the nuisance exists; the City did mail written notice <br />of the proposed abatement to all persons owning property described in Resolution <br />No. 94-34 in the time, form and manner prescribed by law; and <br /> <br />WHEREAS the City Council did hold a public hearing on May 17, 1994, and no one <br /> appeared to raise objections; <br /> <br />NOW, TItEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section i: <br /> <br />The Fire Inspector is ordered to abate the nuisance declared by Resolution No. <br />94-34 by having the weeds, rubbish, and refuse removed and for this purpose, the <br />Firo Inspector may enter upon private property to abate the nuisance. Before the <br />Firo Inspector arrives, any propercy owner may remove the weeds, rubbish or <br />refuse at their own expense. <br /> <br /> <br />
