CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 94-53 <br /> <br />RESOLUTION REVERSING THE DECISION OF THE <br />PLANNING COMIVIISSION REGARDING R & S LAWN <br />SERVICE (CASE AP-94-03) <br /> <br />the Planning Commission was asked to make a determination as to whether a <br />landscape maintenance business, with an office and on-site storage of trucks and <br />equipment, should be considered as a permitted use, a conditional use, or a non- <br />permitted use in the C-C (Central Commercial) District; and <br /> <br />the Planning Commission held a duly noticed public hearing and after considering <br />all information determined that a landscape busthess, with an office and on-site <br />storage of trucks and equipment, is a conditional use, similar to "janitorial <br />services and supplies," in the C-C (Central Commercial) District; and <br /> <br />WHEREAS that decision was appealed by the City Council for further review; and <br /> <br />WHEREAS, <br /> <br />on May 3, 1994, a duly noticed public heating was held before the City Council <br />at which time the applicant and other members of the public were offered an <br />oppermnity to present evidence regarding this appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The City Council upholds the appeal, reverses the Planning Commission <br />determination that a landscape maintenance service is a conditionally permitted <br />use in the C-C (Central Commercial) District, and therefore determines that the <br />proposed application of R & S LawQ Service for establishing a business at 201 <br />Spring Street, as described above, is a non-permitted use in the C-C (Central <br />Commercial) District. <br /> <br />S~on2: This resolution shall become effective immediately upon its passage and adop~on. <br /> <br /> I HEREBY CERIII~Y THAT TIlE FOREGOING WAS DULY AND <br />REGULARLY ADOFrED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HEI,D ON MAY 3, 1994 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Dennis, Pico, and Scribner <br />Councilmember Mohr and Mayor Tarver <br />None <br />None <br /> <br />A~A~ F~ <br />Michael H.
