Section 3. Termination of 1987 Site Lease. The 1987 Site Lease, recorded as Document No. in the official records of the Alameda County Recorder, is terminated and is of no further force or effect. Section 4. Termination of Estate in Years. The CorporaTion hereby acknowledges nnd agrees that. upon the execution and delivery of the Escrow Instructions, and the deposit of moneys and securities into the Escrow Accounts established thereby, the 1987 Certificates shall be deemed to have been fully paid and retired, and the estate in years rctmned by the Corporation pursuant to the Deed of Oi~ is hereby terminated. Section g. Termination of 1988 Facility Lease. The 1988 Facility Lease, recorded as Document No. in the official records of the Alameda County Recorder, is terminated and is of no further force or effect. Section 6. Termination of 1988 Assignment Agreement. The t988 Assignment Agreement, recorded as Document No. in the official records of the Alameda County Recorder, is terminated and is of no funher force or effect. Section 7. Conveyance of Site 2. The Corporation hereby acknowledges and egress that, upon the execution and delivery of the Escrow Instructions, and the deposit of moneys and securities into the Escrow Accounts established thereby, the 1988 Certificates shall be deemed to have been fully paid and retired and all Base Rental payments shall be deemed paid. Pursuant to Section 5.03 of the 1988 Facility Lease, the Corporation, for valuable consideration, the receipt of which is hereby acknowledged, hereby grants to the City all the real property, and improvements thereon, described in Site 2. Section 8. Applicable Law. This Tgrmination Agreement shall be governed by and consir, ted in accordance with the.laws of the State of California.
