CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-069 <br /> <br />RESOLUTION AGREEING TO THE EXCHANGE OF <br />PROPERTY TAX REVENUE FOR ANNEXATION NO. 146 <br />(FULLER/SMATHERS) <br /> <br />WHEREAS, <br /> <br />Section 99 of the Revenue and Taxation Code (AB 8) provides, among other <br />things, that no local agency jurisdictional change can be completed without the <br />agencies affected by such change first having agreed upon an exchange of property <br />tax revenue between and among the aff~ected agencies; and <br /> <br />WHEREAS, <br /> <br />the Alameda County Mayor' Conference, the City of Pleasanton (Resolution No. <br />8074) and the Alameda Comity Board of Supervisors (Resolution No. 186574) <br />have agreed to a method for equitably distributing the property tees; and <br /> <br />WHEREAS, <br /> <br />such specific annexation needs a resolution ~om both the City and County <br />agreeing to the exchange of property tax revenues for the annexation to be <br />completed and filed with the State. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />That for Annexation No. 146 (Fuller/Smathers) by the City of Pleasanton, which <br />will be first eflbctive for the fiscal year following the filing of the Certificate of <br />Completion with the State Board of Equalization providing the filing occurs prior <br />to December 31 of the preceding year, the Auditor-Coutroller of the County of <br />Alameda shall be directed to cause an exchange of property tax revenues pursuant <br />to the provisions of Paragraphs No. 1 and 3 of the attached City/County agreement. <br /> <br />Section 2: <br />Section 3: <br /> <br />The City certifies that there is no significant commercial and/or industrial <br />development in the proposed annexation. <br /> <br />That the property tax proceeds accruing for the Structural Fire Fund shall be <br />transferred to the City of Pleasanton. <br /> <br /> <br />
