CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 00-040 RESOLUTION APPROVING THE REQUEST OF PASSPORT HOMES TO RECONSIDER CONDITION NO. 6 (SCHOOL CONDITION) FOR PUD-98-08 (PANGANIBAN PROPERTY) WHEREAS, Passport Homes has requested mconsideration of its conditions of approval for PUD-98-08 to delete Condition No. 6 which requires that no building permit be issued or lot sold for any of the six new homes within the project until after the new elementary school located on Case Avenue is operational; and WHEREAS, the condition of approval also allows for the applicant to request modification of this condition based on the progress being made on the construction of the new elementary school being planned on Case Avenue or other new elementary school, with the intent that no homes shall be occupied until the school is opened; and WHEREAS, the City Council held a public hearing at its regular meet'rag of April 18, 2000 to consider Passport Homes' request; and WHEREAS, after considering all evidence, public testimony, and staff recommendation, the City Council determined that the construction of the Phoebe Apperson Hearst Elementary School on Case Avenue and the Hart Middle School in Hacienda Business Park are progressing at a rate which will permit the schools to be operational in August 2000; and WHEREAS, based on this information the City Council agreed to permit Passport Homes, and other similarly conditioned developers (Lemoine Property [Delco Builders], TTK Parmership, City of Pleasanton Golf Course Lots, Nolan Farms [SummerHill Homes], Sycamore Heights [New Cities], Bozorgzad Property, Mardel et al. [Delco Builders]) to obtain building permits because the school timing condition has been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the request of Passport Homes, and finds that the school timing condition (Condition No. 6 of PUD-98-08) has been satisfied.
