CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-040 <br /> <br />RESOLUTION APPROVING THE REQUEST OF PASSPORT <br />HOMES TO RECONSIDER CONDITION NO. 6 (SCHOOL <br />CONDITION) FOR PUD-98-08 (PANGANIBAN PROPERTY) <br /> <br />WHEREAS, <br /> <br />Passport Homes has requested mconsideration of its conditions of approval for <br />PUD-98-08 to delete Condition No. 6 which requires that no building permit be <br />issued or lot sold for any of the six new homes within the project until after the <br />new elementary school located on Case Avenue is operational; and <br /> <br />WHEREAS, <br /> <br />the condition of approval also allows for the applicant to request modification of <br />this condition based on the progress being made on the construction of the new <br />elementary school being planned on Case Avenue or other new elementary school, <br />with the intent that no homes shall be occupied until the school is opened; and <br /> <br />WHEREAS, the City Council held a public hearing at its regular meet'rag of April 18, 2000 to <br /> consider Passport Homes' request; and <br /> <br />WHEREAS, <br /> <br />after considering all evidence, public testimony, and staff recommendation, the <br />City Council determined that the construction of the Phoebe Apperson Hearst <br />Elementary School on Case Avenue and the Hart Middle School in Hacienda <br />Business Park are progressing at a rate which will permit the schools to be <br />operational in August 2000; and <br /> <br />WHEREAS, <br /> <br />based on this information the City Council agreed to permit Passport Homes, and <br />other similarly conditioned developers (Lemoine Property [Delco Builders], TTK <br />Parmership, City of Pleasanton Golf Course Lots, Nolan Farms [SummerHill <br />Homes], Sycamore Heights [New Cities], Bozorgzad Property, Mardel et al. <br />[Delco Builders]) to obtain building permits because the school timing condition <br />has been satisfied. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves the request of Passport Homes, and finds that the school timing <br />condition (Condition No. 6 of PUD-98-08) has been satisfied. <br /> <br /> <br />
