CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 00-042 <br /> <br />RESOLUTION DENYING REQUEST TO WAIVE LOWER <br />INCOME HOUSING FEES FOR THE 36-UNIT NOLAN <br />FARMS RESIDENTIAL PROJECT (PUD-99-5/TRACT 7143) <br /> <br />WHEREAS, <br /> <br />SummerHill Homes (Developer) received approval to construct a 36-unit <br />residential development CNolan Farms"; PUD-99-5/Tract 7143) on an <br />approximately 13.4 acre site located at Rose Avenue and Fair Street; and <br /> <br />WHEREAS, <br /> <br />the Developer agreed to sell to first time home buyers five of the 36 homes within <br />the residential development under an affordability program such that the homes <br />would be affordable to persons with incomes at 80% of the median income; and <br /> <br />WHEREAS, the Developer has requested a waiver of the City's Lower Income Housing Fee for <br /> all 36 units in the project (currently $2,888 per unit, or $89,528 in total); and <br /> <br />WHEREAS, <br /> <br />the provision of affordable for-sale housing for "low income" households is a need <br />which is expressed in the City's General Plan Housing Element and in the HUD <br />Consolidated Planning Strategy; and <br /> <br />WHEREAS, <br /> <br />at its meeting of April 18, 2000, the City Council reviewed the report of the <br />Housing Division (SR 00:101 ) regarding the proposed waiver of $89,528 in Lower <br />Income Housing Fees for the Nolan Farms residential project; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br />Section 2: <br /> <br />Council denies the request for a waiver of the Lower Income Housing Fee for all <br />36 units in the Nolan Farms residential project. <br /> <br />Directs staff to collect the Lower Income Housing Fee for the entire project and <br />allocate those fees, plus an amount from the Affordable Housing Fund, so as to <br />total $250,000, which shall be applied to the five affordable units in the Nolan <br />Farms project so that the sales price for those five units will be $130,000. <br /> <br /> <br />
