RESOLUTION NO. 74-229 RESOLUTION ~ENDING AGREEMENT WITH ENGINEER OF WORK IN ASSESSMENT DISTRICT NO. 1974-10~ PETERS AVENUE PARKING L.I.D., CITY OF PLEASANTON, ALAMEDA COUNTY, CALIFORNIA WHEREAS, the contract for engineering services in Assessment District No. 1974-10, Peters Avenue Parking L.I.D., City of Pleasanton, Alameda County, California, provided for the lump-sum compensation to MacKAY & SOMPS in the amount of $11,000.00; and WHEREAS, because of additional work and expenses in connection with the preparation of a wage schedule and amendment of the plans, included as part of the Engineer's Report previously filed herein, the Engineer of Work has requested approval of an additional fee in the amount of $600.00; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasanton, Alameda County, California, that that certain agreement dated the 14th day of October, 1974, between the CITY OF PLEASANTON and MacKAY & SOMPS be amended by deleting Paragraph 3 thereof and substituting the following paragraph: "3. Second Party shall receive compensation for the above services as follows: A lump sum in the amount of $9,100.00 for completion of plans; specifications, assessment district docu- ments; parcel map; collection and editing of data necessary to prepare wage schedule; and modification of the plans and assessment district documents due to the deletion of improvements on the Mayer property (Assessment No. 1), payable upon receipt of the pro- ceeds of assessments collected and/or bonds sold. A lump sum in the amount of $1,500.00 for construction staking and job coordination, payable upon completion of construction. A lump sum in the amount of $1,000.00 for completion of assessment district proceedings and final engineer's report, payable upon completion of tile final engineer's report. The above amount shall be paid by First Party out of the proceeds of assessments levied and bonds to be issued in said pro- ceedings." -1-
