Section 2. <br /> <br /> (1) <br /> <br />(2) <br /> <br />(3) <br /> <br /> has been submitted for imposing upon ten individ- <br /> ual property owners the obligation for maintain- <br /> ing, repairing and improving a road with the <br /> length and grade shown on Tentative Map #3256. <br /> <br /> (5) There has been no demonstrated benefit which <br /> would accrue to the City by making the proposed <br /> road a private road. <br /> <br /> (6) The private roads which have been approved in <br /> the past by the City have been in conjunction <br /> with planned unit developments or multi-family <br /> developments where the private street serv~ the <br /> function of a private driveway and there was <br /> easy and convenient access to a public street. <br /> In addition, developments with private streets <br /> have all been constructed on relatively flat <br /> land and not on any property with a length and <br /> grade comparable to the proposed 1700 feet of <br /> 20% grade on Tentative Map #3256. <br /> <br />The City Council further determines: <br /> <br /> Santos Ranch Road, a public street having a sustained <br /> grade of 20% which has been closed to public travel <br /> by the Alameda County Board of Supervisors, is a <br /> prime example of the types of dangers which could be <br /> encountered on the proposed Longview Lane, especially <br /> with its proposed narrow width. <br /> <br /> The Castlewood area is no justification for allowing <br /> the proposed Longview Lane since Castlewood developed <br /> in the County; homes are adjacent to the street and <br /> not set back great distances, thus affording easy <br /> fire and police protection; no sustained grades exist <br /> comparable to those in Longview; there are alternate <br /> means of ingress and egress within the development to <br /> accommodate traffic; fire protection is provided only <br /> because Castlewood was preexisting with narrow roads <br /> and aCountyservice district was established whereby the <br /> City of Pleasanton by contract provides limited fire <br /> <br /> protection services. <br /> <br /> The City of Pleasanton will face potential liability <br /> for the design of the proposed road and as such the <br /> maximum in safety should be incorporated where the <br /> maximum in grade is requested.
